10 ARCHITECTURAL CONTROL


 

ARCHITECTURAL CONTROL


1. No person shall make any change or alteration of any sort to the buildings structures, exterior paint, or fences WITHOUT THE PRIOR EXPRESS, WRITTEN CONSENT of the Board of Directors of the Cascade Gardens Community Association. All requests for an architectural change must be submitted in duplicate to the Board on an Architectural Change Request Form, which must be completely filled out. These forms are available through the management company. The Board will consider any written request for an architectural change at its next regularly scheduled meeting and the requesting owner shall be advised of the Board’s decision. Please submit copies of your contractor’s license and insurance certificates with your change request. Please keep the following in mind when submitting your requests: The approved color for screen doors is black, and flag displays must conform to state guidelines.

2.  Satellite dishes may be placed only in “exclusive use” common areas such as patios and balconies. They may not be placed on the roof. The maximum permissible dish size is 18 inches in diameter.

3.  Absent prior approval from the Board, satellite dishes may not be permanently attached to any common area property (railings, fences, stucco, etc.), and may not extend beyond balcony or patio fence boundaries. An owner may seek an exception to this rule by submitting an Architectural Change Request Form to the Board and demonstrating good cause (for example, reception problems). To preserve architectural continuity, it is the policy of the Board to consider granting a request for extension beyond balcony rails only where the balcony overlooks a unit’s patio/backyard. Violators of this rule shall be subject to fines, and shall be responsible for any resulting damage to common area property.

4. All additions to units, permanent or temporary, shall REQUIRE a license and indemnity agreement to be signed by the unit owner, recorded with the San Diego County Record’s Office, and FILED with the Association’s permanent records. All additions are the RESPONSIBILITY of the owner to maintain in good condition and a proper working order.
