GENERAL ISSUES
1. An owner shall be responsible for any liability incurred by the
Association as a result of that owner’s violation of the Rules and Regulations
and/or city ordinances. Owners are responsible for any damages done to common
area property by contractors they may employ.
2. The
Association will charge owners a $50 fee for dishonored checks.
3. The use of any portion of a living unit for commercial purpose, if in
any way detectable or detracting from appearances, is prohibited. Use of
parking or common areas for any commercial purpose is prohibited. The Board can
impose fines as high as $100 for each initial violation.
4. Each owner of a condominium shall be responsible for the exterior and
interior maintenance and repair of all doors and windows enclosing the living
unit (except the outside of the front wooden door), and their own mailbox lock
cylinder. This includes all window and door screens. For replacement see
Architectural Control.
5. One appropriate “For Sale” sign may be placed on the inside of both a
front and rear window of a unit (Maximum 2 signs per unit). Signs, posters and
advertising media such as “For Sale” signs shall not be attached to or placed
on the building or the Association common areas (including balconies and
patios) without prior written Board approval.
6. Window coverings shall be limited to properly installed and fitted
drapes, blinds, or shade materials specifically for such use. White and
near-white outward-facing colors are approved. Coverings shall be kept in a
state of good maintenance.
7. No antennas, satellite dishes, wires, or poles shall be erected
anywhere on the common area except as permitted by law and for which the owner
has submitted an architectural change request form.
8. The parking lot is not meant to be a playground. Children should be
under adult supervision, at all times, while in common areas.
9. Bike riding, skateboarding, roller-skating, rollerblading or use of
toy scooters is prohibited on common areas.
10. The fountain area (east of the pool) is NOT for
climbing, playing, or loitering. Please contact the police or Neighborhood
Watch if you see any dangerous activity in this area, including graffiti
writing.
11. If you see damaged or broken water lines, irrigation sprinklers,
fences, electrical boxes, damaged landscaping, graffiti or anything that must
be repaired immediately, please contact our property management company.
Homeowners also need to report any safety concerns.
12. There is a water shutoff valve on each building. Owners must post
notice near mailboxes and/or at each door 48-72 hours in advance of shutoff, or
in the event of an emergency inform every resident of the building. The Board
will not tolerate water shutoff without proper notice. The hot water
recirculation pump must also be shut off to prevent damage when water is turned
off for the entire building. Contact the Board or call management for a key to
the utility room and instructions.
13. Adherence to the Safe Streets Policy (appended) is requested.
(Essentially it prohibits illegal drugs, protects other residents, and
prohibits illegal gang activity.) Owners renting their unit are required to include
this in their rental agreement.
14. Due to the number of owners and renters reporting not having
received rulebooks, keys, parking placards, or other important items, all new
owners, (within 30 days of closing escrow) and all new adult residents, (within
30 days of move-in) are required to sign and return the Cascade Gardens Move-in
Checklist. Any items not received should be immediately requested (from the
owner or management) so that the checklist can be returned on time. (If those
items need to be replaced by the management agency, a replacement fee may
apply.)
15. Parents are financially responsible for any damage their children do
to landscaping or other common areas.
16. To maintain a good appearance, screen doors at the front of the unit
may not be habitually left open for extended periods of time (i.e. multiple
hours of multiple days).
17. Owners shall maintain (working) smoke detectors in their unit, in
compliance with state law.
18. Residents have an obligation not to needlessly waste common
resources. In particular this means repairing leaky faucets and toilets. Residents must also adhere to all
city/state mandated water restrictions: (1) Vehicle washing is only allowed
with a hand-held container or a hand-held hose with a positive shut-off nozzle
for quick rinses. (2) Residents cannot use a running hose to wash down
sidewalks and driveways. (3) Residents shall not allow water to leave the
property due to drainage onto adjacent properties or public or private roadways
or streets or gutters. The Board has the right to fine residents for violations
of city ordinances accordingly.
19. Residents are expected to report in a timely manner if they observe
slab leaks (sudden extreme hot spot on the lower floor is a hot water slab
leak) and roof leaks.
